Certain products or services may be available exclusively online through our website. These products or services may be available in limited quantities and may only be subject to returns or exchanges.
We have done our best to display as clearly as possible the colours and images of our products that appear on our shop. We cannot guarantee that your computer screen will display the colours accurately.
We reserve the right, but are not obligated, to limit sales of our products or services to any person, geographic area or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any product or service we offer. All product descriptions and product prices are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue offering any product at any time. Any offer of service or product made on this site is void where prohibited by law.
We also reserve the right to withhold assistance or favourable response on orders that have been placed for more than 60 days without any request from the customer during that time. If an order is undelivered, lost or an error has been made, we are not obliged to act after the 60 day period if no written email request is made to our customer service department for obvious reasons of limitation of liability.
We do not guarantee that the quality of any products, services, information, or other merchandise obtained or purchased by you will meet your expectations, or that any errors in the Service will be corrected.
SECTION 6 - DELIVERY
The delivery time is 7 to 15 working days from the date of shipment. This duration is indicative and corresponds to the usual average but can vary according to the periods of the year and the local subtleties related to the address of each customer.
Unless otherwise stated on the Site during the ordering process or in the description of the Products ordered, CLUB OCEAN undertakes in all cases to deliver the Products within a maximum of thirty (30) days after the conclusion of the contract with a Consumer Client.
Any delay in delivery in relation to the date or time indicated to the Consumer Client when ordering or, in the absence of indication of a date or time when ordering, exceeding thirty (30) days from the conclusion of the contract may result in the cancellation of the sale at the initiative of the Consumer Client, upon written request by the Consumer Client by registered letter with acknowledgement of receipt, if after having enjoined the Seller to carry out the delivery, the Seller has not done so. The Consumer Customer will then be refunded, at the latest in the fourteen (14) days following the date on which the contract was denounced, of the totality of the paid sums. This clause is not intended to apply if the delay in delivery is due to a case of force majeure.
SECTION 7 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, reduce or cancel quantities purchased per person, per household or per order. These restrictions could include orders placed by or from the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we change an order or cancel an order, we may attempt to notify you by contacting you at the email and/or billing address/phone number provided at the time the order was placed. We reserve the right to limit or prohibit orders that, in our sole judgment, may appear to be from merchants, resellers or distributors.
You agree to provide current, complete and accurate order and account information for all orders placed on our store. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we may complete your transactions and contact you if necessary.

SECTION 16 - SEVERABILITY

ARTICLE 18 - FACILITATOR ROLE
ClubOcean does not act as a seller or importer of the products offered on the clubocean.co. Its responsibility is limited to providing a technological platform for intermediation between the buyer and the supplier.
All orders placed via the ClubOcean platform are subject to a contract concluded directly between the buyer and the supplier of the product concerned.
Supplier's liability
The supplier is responsible for the entire process of importing the products into the buyer's territory, including the payment of any applicable taxes or customs duties.
ARTICLE 19 - ASSOCIATIONS
The CLUB OCEAN Brand, represented by CLUB OCEAN does not constitute and does not pretend to be an association or non-profit organization. Its commercial activity is defined and operated by CLUB OCEAN.
The non-profit associations or organizations presented by CLUB OCEAN as having benefited from donations from CLUB OCEAN as a result of the activity and commitments held by CLUB OCEAN are not partners, under contract or under any form of obligation with CLUB OCEAN.
The use of their Name, Image, Photos and content is subject to their exclusive intellectual property and are not represented by CLUB OCEAN.
CLUB OCEAN does not claim to represent any association or non-profit organization. The presentation of their existence, image, content and intellectual property is made only for information purposes and according to the commitments of CLUB OCEAN.
ARTICLE 20 - COMPLETENESS OF THE AGREEMENT
Any failure on our part to exercise or enforce any right or provision of these Terms and Conditions of Sale and Use shall not constitute a waiver of such right or provision.
These Terms of Service or any other operating policies or rules posted by us on this site or in connection with the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, and supersede all prior and contemporaneous communications, proposals and agreements, oral or written, between you and us (including, but not limited to, any prior version of the Terms of Service).

CLUB OCEAN refers to "tracking" or "GPS tracking" as the free service offered for the purchase of so-called "tracking" bracelets sold on this online store.
The tracks are a virtual experience of discovery and awareness of the endangered animals represented by Club Ocean (Sea Turtles, Sharks, Polar Bears, Dolphins and Whales). The tracks feature stories, photos and information produced by Club Ocean based on real GPS tracking or animal rescue information.
The publication and free distribution of the tracking service does not constitute a scientific publication.
The completeness and veracity of the information presented in the tracks is not guaranteed.
Club Ocean reserves the right to interrupt the free distribution or the distribution of the tracking service at any time.
